By accessing and using the website and its services, you agree to abide by the provisions of this agreement. If you do not agree to these Terms, you must refrain from using the website and services. We reserve the right to modify this agreement at any time, and such modifications shall be effective upon posting on the website. By continuing to use the website and services following the posting of any modifications, you agree to be bound by the updated terms; therefore, it is important that you review this agreement periodically.
EvilAI Suite reserves the right, in its sole discretion, to refuse to provide services to any user and to modify its eligibility criteria at any time. This provision shall be inapplicable in those jurisdictions where it is prohibited by law and, in such cases, the right to access the website and services will be revoked.
By using the website and services, you represent and warrant that you have full power, authority and capacity to enter into this agreement and to perform all obligations hereunder. You further represent and warrant that you are not subject to any legal incapacity or contractual restriction that would prevent you from entering into this agreement.
2. Communications and Newsletters
By registering on the website, you agree that we may use your email address to send you notifications and communications related to the website. If you do not wish to receive these emails, you may opt out by sending us your request via our contact information or by using the 'unsubscribe' option that appears in the emails themselves.
3. Registration and User Account
To access and use the services offered by EvilAI Suite, the user must complete the registration process through Discord, using the OAuth authentication system. By registering in this manner, the user authorizes the stream of certain data from their Discord account, such as their username, email address, avatar, unique identifier and the technical information necessary for session validation, in order to enable access to the platform.
Users acknowledge and agree that they are solely responsible for the accuracy and truthfulness of the information they provide during the registration process and for keeping it up to date at all times, including the correct linking of their TradingView username to ensure access to the indicator. They also undertake to safeguard the security of their Discord account and understand that any unauthorized access resulting from misuse, negligence or lack of diligence in protecting their credentials will be their sole responsibility.
EvilAI Suite reserves the right to deny or cancel access to users who violate these terms, use false data, or misuse the platform. Registration and account creation imply full and unreserved acceptance of these Terms and Conditions and constitute the contractual basis governing the relationship between the user and EvilAI Suite.
4. Subscriptions
Access to the EvilAI Suite indicators on TradingView is subject to the purchase of a subscription plan, available on a monthly billing basis at $179.95 per month. By selecting and purchasing a subscription, the user authorizes the automatic and recurring charge of the corresponding amount to the payment method provided through our payment processor (Stripe). This charge will be made periodically in accordance with the chosen billing cycle and will remain in effect as long as the subscription is not cancelled by the user or suspended for breach of these terms and conditions.
The subscription grants the user the right to access and personal use of the indicators (including ML E.signal, Trend Magnitude, True Break Signals, SharkFood, Range Fuel, ML Comprehensive Trade Management, Stacks Z, Whalemap, Stacks Z GC, and ICEBERG) while it is active and up to date with payments. In the event that the automatic charge cannot be completed, for example, due to insufficient funds, expiry of the payment method or technical problems with the processor, access to the service may be suspended immediately until the situation is resolved. It is the sole responsibility of the user to keep their payment method up to date and valid in order to avoid interruptions to the service.
The user may cancel their subscription at any time through the Stripe Customer Portal, which will prevent the next billing cycle from being charged. Cancellation will not generate partial or total refunds for periods already started, and access to the service will continue until the end of the contracted period. EvilAI Suite does not offer extensions, compensation or refunds for unused time in the event of early cancellation.
5. Refunds
All subscription purchases made through EvilAI Suite are final and are not subject to refund, either in full or in part, once payment has been confirmed. The user acknowledges and accepts that, by purchasing a monthly subscription, they obtain immediate access to the indicators on TradingView, which makes it impossible to refund the amounts paid. However, the user retains the right to cancel their subscription at any time, which will prevent the corresponding charge from being made for the next billing period. Cancellation will not affect the period already paid for, so access to the services will remain active until the end date of the current subscription.

By purchasing a subscription, the user expressly agrees that access to the service is enabled immediately and waives their 14-day right of withdrawal in jurisdictions where this right is mandatory, such as in the European Union and the United Kingdom.
6. Limitation of Liability

EvilAI Suite provides users with technical indicators for use on the TradingView platform, which are support tools for informational and educational purposes only. The user acknowledges and accepts that these tools do not constitute, under any circumstances, financial, legal, tax, investment or any other type of advice, and that they are not intended to replace the professional judgement of accredited financial advisors or to serve as the sole or definitive basis for investment decisions.
EvilAI Suite does not guarantee the accuracy, completeness, reliability or continuous availability of the data, indicators, calculations or results generated by the tools, nor does it ensure that their use will lead to financial gains, risk reduction or the fulfillment of investment expectations. The user assumes all risks arising from the use of the indicators, including, but not limited to, financial losses, property damage, market fluctuations, service interruptions, calculation errors or delays in the execution of processes.
To the fullest extent permitted by applicable law, EvilAI Suite excludes all liability for direct, indirect, incidental, special, consequential or punitive damages that may arise from access to, use of or inability to use the indicators, the website, integrations with Discord or TradingView, or any other circumstance related to the services provided. EvilAI Suite assumes no responsibility for technical failures, network interruptions, system errors, unauthorized access, loss of data or damage resulting from the actions of third parties beyond its control.
7. Affiliate Programme
EvilAI Suite offers its users the opportunity to participate in an affiliate programme through which they can earn money by recommending our service to others. Upon registering for the programme, users will be provided with a unique referral code that they can share with others to use when purchasing a subscription. Each time a third party completes a purchase using that code, the affiliate will receive a commission equivalent to ten per cent (10%) of the value of the transaction. The commission will be calculated solely on the amount actually paid by the new subscriber, excluding processing fees or taxes.
The amount accumulated in commissions will be managed by EvilAI Suite and paid out via PayPal Mass Payouts. EvilAI Suite reserves the right to establish minimum accumulation thresholds before proceeding with payments, as well as to review, suspend or cancel any participation in the programme in the event of detecting fraudulent activities, misuse of the code or breach of these terms and conditions.
Affiliates retain earned commissions even if the referred customer cancels their subscription, but future recurring commissions will cease upon cancellation.
8. Copyright and Intellectual Property
All content on the EvilAI Suite website, including but not limited to the design, text, graphics, logos, icons, images, source code, databases and the indicators developed for use on TradingView, is protected by applicable intellectual property and copyright laws. Access to the services does not confer on users any ownership rights over such content, and its reproduction, distribution, public communication, sublicensing, decompilation or any other unauthorized use is prohibited without the prior express consent of the owners. Any infringement will be prosecuted in accordance with current legislation, without prejudice to any civil or criminal actions that may apply.
9. Personal Data and Privacy
Any personal information you submit in connection with your use of the website and our services will be used in accordance with our privacy policy. By using the website and our services, you consent to our collection and storage of your personal information as outlined in our privacy policy.
10. Prohibited Activities
The following activities are prohibited:
- Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any content of the services, including but not limited to, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with this agreement or without our express written permission
- Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services
- Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure
- Deep-link to any portion of the services for any purpose without our express written permission
- "Frame", "mirror" or otherwise incorporate any part of the website into any other websites or service without our prior written authorization
- Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by EvilAI Suite in connection with the services
- Circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content
- Share, resell, or provide access to the indicators to any third party
- Use the services for any fraudulent or illegal purpose
11. Disclaimer of Warranties
Due to the nature of the Internet, EvilAI Suite provides and maintains the website on an "as is", "as available" basis and does not promise that use of the website will be uninterrupted or error free. We will not be liable to you if we are unable to provide the website or our services for any reason beyond our control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
- WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- WE SHALL NOT BE LIABLE FOR TRADING LOSSES, MISSED OPPORTUNITIES, OR INVESTMENT DECISIONS

12. Account Termination
We reserve the right to suspend or terminate your access to the services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.
Upon termination, your right to access and use the services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.
13. Fraud Prevention and Blacklist
EvilAI Suite maintains a permanent blacklist system to prevent fraudulent activities, including but not limited to chargebacks, payment disputes, account sharing, and violation of our terms. Users placed on the blacklist will be permanently prohibited from accessing our services, regardless of payment status or subscription status. This blacklist enforcement cannot be bypassed through any means.
